Official Rules

NO PURCHASE NECESSARY

The iGoogle Gadget Contest in the UK, Spain Germany and France (the "Contest") is designed to promote the creation of new iGoogle Gadgets. A prize will be awarded to the entrant who submits the best entry, as determined by the judges in accordance with these rules of the contest (“Official Rules”). The sponsor of the Contest is Google, Inc of 1600 Amphitheatre Parkway, Mountain View, CA 94303 (“Google”). Entry in the Contest constitutes your acceptance of these Official Rules, which are available at http://www.google.com/intl/en_uk/events/gadgetawards/rules.html during the Contest Period (as defined below).

  1. Language: Where Google has provided you with a translation of the English language version of the Official Rules, then you agree that the translation is provided for your convenience only and that the English language version of the Official Rules will govern your relationship with Google. If there is any contradiction between what the English language version of the Official Rules says and what a translation says, then the English language version shall take precedence.

  2. Eligibility: The Contest is open to any natural person who is (i) a legal resident of the European Union and (ii) at least 18 years old at the time of entry. Employees and agents of (i) Google, its affiliates or subsidiaries; or (ii) any other entity involved in the development, production, implementation or fulfilment of the Contest; and (iii) the immediate family members (defined as parents, children, siblings and spouse) and/or persons living in the same household as such individuals; are not eligible to participate in the Contest.

  3. How to Enter: The Contest begins at 12:01am (GMT) on 31 May 2007 and ends at 11:59 pm (GMT) on 30 June 2007 (the "Contest Period"). To enter, you must visit the Contest website at http://www.google.com/intl/en_uk/events/gadgetawards/rules.html and follow the instructions. All entries must be in English, French, Spanish or German. Only eligible entries received by Google during the Contest Period will be considered by the judges. Proof of submission does not constitute proof of receipt. Illegible, unintelligible, incomplete or garbled entries will be disqualified. All entries submitted must represent your original work, may not have been previously published or sold, and may not contain any material which, in Google’s sole discretion, is obscene, profane, improper or unlawful. If you submit the same gadget multiple times, only the last submission of that gadget within the Contest Period will be judged. The submission of an entry is your sole responsibility. Automated entries (including but not limited to entries submitted using any bot, script, macro or contest service), copies, third-party entries, facsimiles and/or mechanical reproductions are not permitted.

  4. Conduct: By entering the Contest, you agree to comply with and be bound by these Official Rules. You further agree to comply with and be bound by the decisions of the judges, which are final and binding in all respects. Google reserves the right, in its sole discretion, to disqualify you if it finds you to: (1) be tampering or attempting to tamper with the entry process or the operation of the Contest; (2) be violating these Official Rules; (3) be violating the terms of service, conditions of use or general rules or guidelines of any Google property or service; (4) be acting in an unsportsmanlike or disruptive manner, or with the intent to annoy, abuse, threaten or harass any other person; (5) have provided any false information; or (6) have violated the rights of any third party.

  5. Prize: If you win the Contest, your entry will appear on the iGoogle page and you will also receive economy class airfares for you and a friend to visit the Googleplex in Zurich, Switzerland. The timing of your visit will be organised in consultation with you, but will ultimately be at the sole discretion of Google. Google will organise accommodation for you and your friend when you are in Zurich. You will be responsible for all other costs and expenses, whatsoever their nature, that you incur in taking up the prize. All taxes and any applicable reporting requirements are your sole responsibility. If you win, you will be responsible for ensuring that you and your friend have all necessary documents and permissions to travel (e.g. Swiss visa). CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, GOOGLE RESERVES THE RIGHT TO SEEK DAMAGES TO THE FULLEST EXTENT PERMITTED BY LAW.

  6. Judging and Selection of Winners: All entries will be judged by a panel of experts based on the following judging criteria: (i) popularity; (ii) visual appeal; (iii) use of new features, eg UI Script API (transparency, animation, etc.), sharing/collaboration through the Google Talk API (interactive games, shared lists, etc.), personalization engine (contextual information, etc.); and (iv) creativity. If no winning entries are received, no prize will be awarded. The judges’ decisions are final and binding. The winner will be announced on or about 15 July 2007 and will be notified via e-mail.

  7. General Conditions: This Contest is governed by the laws of the State of California, United States. Any potential winner who cannot be contacted within fifteen (15) days of attempted first notification will forfeit his or her prize. Return of the prize notification may result in disqualification and selection of an alternate winner. Potential prize winners may be required to sign, notarize and return an Affidavit or Declaration of Eligibility, a Liability/Publicity Release, and/or I.R.S. Form W-9 and provide any additional information that may be required by Google within thirty (30) days following the date of first attempted notification. Failure to comply within these time frames may result in disqualification and selection of an alternate winner. The intellectual and industrial property rights to your entry to the Contest, if any, will remain with you. Your use of any other Google product or service may be subject to additional terms and conditions. You agree that Google shall have the right to use, copy, reproduce, publish, modify and make available your entry to the public for any purpose, including but not limited to advertising and promotion of the Contest using the entry itself and/or screenshots, animations and video clips. Acceptance of a prize constitutes permission for, and your consent to, use of your name, likeness and entry for advertising and promotional purposes without additional compensation. Google is not responsible for any typographical or other error in the administration of the Contest. You certify that your entry is original and that you are the sole and exclusive creator, owner and rights holder of the submitted entry and that you have the right to submit the entry to the Contest. You agree not to submit any entry that (i) infringes any third-party proprietary, intellectual property, industrial property, personal rights or other rights, including without limitation, copyright, trademark, patent, trade secret or confidentiality obligation; or (ii) otherwise violates applicable law. If a winner/potential winner's employer has a policy which prohibits the awarding of a prize to an employee, the prize will be forfeited and an alternate winner will be selected.

  8. No Recourse to Judicial or Other Procedures: To the extent permitted by law, the rights to litigate, to seek injunctive relief or to any other recourse to judicial or any other procedure in case of disputes or claims resulting from or in connection with this Contest are hereby excluded and you expressly waive any and all such rights.

  9. Privacy: By entering the Contest, you agree to Google’s use of your personal information as described in Google's Privacy Policy, which can be found at http://www.google.com/intl/en_uk/privacy.html. You further agree that data received by Google as part of this Contest may be processed, stored, shared with Contest judges and otherwise used for the purposes and within the context of the Contest. Google will collect additional information from Contest winners, and may use this data in distributing prizes and/or to verify eligibility to participate in the Contest. Names of Contest winners will be publicized. If the required data is not provided, you will be ineligible to participate in the Contest.

  10. LIMITATIONS OF LIABILITY: YOU INDEMNIFY AND AGREE TO KEEP INDEMNIFIED GOOGLE AND ITS PARENTS, AFFILIATES OR SUBSIDIARIES AND THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES AND ASSIGNS AT ALL TIMES FROM AND AGAINST ANY LIABILITY, CLAIMS, DEMANDS, LOSSES, DAMAGES, COSTS AND EXPENSES RESULTING FROM (i) YOUR PARTICIPATION IN THE CONTEST; (ii) USE OR ACCEPTANCE OF ANY PRIZE WON; AND/OR (iii) ANY ACT, DEFAULT OR OMISSION OF YOURS IN BREACH OF THESE OFFICIAL RULES.

  11. Internet: Google is not responsible for electronic transmission errors resulting in omission, interruption, deletion, defect, delay in operations or transmission. Google is not responsible for theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions or limitations of any kind. Google is not responsible for inaccurate transmissions of or failure to receive entry information on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof. If for any reason the Internet portion of the Contest is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Contest, Google reserves the right at its sole discretion to cancel, terminate, modify or suspend the Contest.

  12. Severability: If any provision(s) of these Official Rules, or part thereof, are held to be invalid or unenforceable, all remaining provisions hereof will remain in full force and effect.

  13. Notification of Winner: The winner of this Contest will announced on or about 15 July 2007 and will be available at http://www.google.com/intl/en_uk/events/gadgetawards for at least thirty (30) days following such announcement.
