A 54-year-old man was arrested Thursday afternoon after being charged with cultivating 70 marijuana plants.

James Patrick Gardner, of Notch Road, was released from the Oxford County Jail on personal recognizance bail. Under his conditions of release, Gardner must not use illegal drugs or alcohol and submit to searches.

On Thursday the California Supreme Court unanimously ruled that breath test results can vary between people. Washington, D.C. -- House appropriations subcommittee has lifted a long-standing budget rider banning the District government from spending any money to decriminalize marijuana.

An international working group of 11 researchers from six countries will recommend that Driving Under the Influence of Drugs (DUID) laws aimed at marijuana users adopt a limit of a set amount of THC in the bloodstream instead of relying on a zero tolerance approach that criminalizes anyone who has any THC or metabolites in his bodily fluids. The holidays are a time of year when law enforcement agencies increasingly target drunk drivers. In keeping with that effort, the federal government, along with Mothers Against Drunk Driving, launched a new anti-DUI campaign this week. Grand Rapids, MI -- Michigan voters overwhelmingly approved a medical marijuana ballot initiative last year. A majority of voters in every county supported the issue, which garnered 63 percent of the ballots cast.

The clear intent was to allow people with certain medical conditions to obtain marijuana to relieve suffering. What the law didn't provide, however, was a legal means for approved users to acquire the drug.

Legislation recently introduced in the state Senate takes aim at that glaring hole in the law. It proposes a distribution system for medical marijuana that includes state-licensed growers and prescriptions filled by pharmacists.

USA -- I'm on the phone getting a recipe for hashish butter. Not from my dealer but from Lester Grinspoon, a physician and emeritus professor of psychiatry at Harvard Medical School. Columbus -- Ohioans favor casino gambling and marijuana used for medical purposes, but they oppose lowering the drinking age, abolishing the death penalty and legalizing gay marriage. Times columnist Gregory Sullivan acknowledges marijuana's therapeutic potential, but he argues that federal law must be changed before New Jersey passes its Compassionate Use Medical Marijuana Act (The Times, "Compassionate, but still illegal," Dec. 30). Mr. Sullivan is apparently unaware of the recent U.S. Supreme Court action in the Garden Grove case, which resolved the conflict between federal and state marijuana laws. The U.S. Supreme Court refused to hear, and thus let stand, a decision from California's Fourth District Court of Appeals, which said: "Congress enacted the Controlled Substances Act (CSA) to combat recreational drug abuse and curb drug trafficking. Its goal was not to regulate the practice of medicine, a task that falls within the traditional powers of the states. ... Congress regulates medical practice (only) insofar as it bars doctors from using their prescription-writing powers as a means to engage in illicit drug dealing ... . Beyond this, however, the statute manifests no intent to regulate the practice of medicine generally."

The Supreme Court affirmed Wednesday that police have the power to conduct searches and seize evidence, even when done during an arrest that turns out to have violated state law.

The unanimous decision comes in a case from Portsmouth, Va., where city detectives seized crack cocaine from a motorist after arresting him for a traffic ticket offense.

David Lee Moore was pulled over for driving on a suspended license. The violation is a minor crime in Virginia and calls for police to issue a court summons and let the driver go.

Instead, city detectives arrested Moore and prosecutors say that drugs taken from him in a subsequent search can be used against him as evidence.

The Seattle Times reports that a bill has been introduced in Washington state that would require convicted D.U.I. offenders to use fluorescent-yellow license plates for a year after their driving privileges are restored. The bill’s sponsors see the license plates as a means of informing law enforcement that the driver has a history of D.U.I.s, and a signal to other drivers to “give a wider berth” to the potentially dangerous driver — not to mention providing an added disincentive for would-be drunk driving. Though whether the threat of public embarrassment serves as a good enough incentive to change behavior remains to be seen.
