Some people are slow learners. Cases in point: This week we have two examples of people being arrested for DUI on consecutive days.

In Brownsville, Texas a man ran  a vehicle off the road at 2 a.m. on a Tuesday. He was arrested, charged with DUI and released about 11:20 a.m. on $3,000 bond

From Independence PD: The Independence Police Traffic Safety Unit along with officers from the Jackson County Traffic Safety Task Force conducted a sobriety checkpoint along northbound Noland Road at Lynn Court in Independence. The operation began on Friday 06/26/09 at 11:00 PM and ended on Saturday 06/27/09 at 3:30 AM.

Washington, D.C. -- House appropriations subcommittee has lifted a long-standing budget rider banning the District government from spending any money to decriminalize marijuana.

The Financial Services panel, which has oversight of D.C., has removed from the 2010 budget 11-year-old language outlawing the District’s use of federal or local funds to legalize marijuana or reduce penalties for its possession or distribution.

An international working group of 11 researchers from six countries will recommend that Driving Under the Influence of Drugs (DUID) laws aimed at marijuana users adopt a limit of a set amount of THC in the bloodstream instead of relying on a zero tolerance approach that criminalizes anyone who has any THC or metabolites in his bodily fluids. Zero tolerance DUID laws are in effect in several countries and several US states.

The holidays are a time of year when law enforcement agencies increasingly target drunk drivers. In keeping with that effort, the federal government, along with Mothers Against Drunk Driving, launched a new anti-DUI campaign this week. During a joint news conference, it was stated that one in four fatal automobile accidents occur during the last two weeks of December and that DUI checkpoints were a way of changing that statistic.

Major General Michael Oates, commander of Fort Drum in northern New York, has decided to prosecute soldiers arrested for drunk driving in military, rather than civilian, court. The Army post has been publishing photos of soldiers accused of NY DWI for several months, though Oates said that effort has not deterred drunk driving enough.

Grand Rapids, MI -- Michigan voters overwhelmingly approved a medical marijuana ballot initiative last year. A majority of voters in every county supported the issue, which garnered 63 percent of the ballots cast.

The clear intent was to allow people with certain medical conditions to obtain marijuana to relieve suffering. What the law didn't provide, however, was a legal means for approved users to acquire the drug.

Legislation recently introduced in the state Senate takes aim at that glaring hole in the law. It proposes a distribution system for medical marijuana that includes state-licensed growers and prescriptions filled by pharmacists.

USA -- I'm on the phone getting a recipe for hashish butter. Not from my dealer but from Lester Grinspoon, a physician and emeritus professor of psychiatry at Harvard Medical School. And not for a party but for my 9-year-old son, who has autism, anxiety and digestive problems, all of which are helped by the analgesic and psychoactive properties of marijuana. I wouldn't be giving it to my child if I didn't think it was safe.

I came to marijuana while searching for a safer alternative to the powerful antipsychotic drugs, such as Risperdal, that are typically prescribed for children with autism and other behavioral disorders.

Marijuana (grass, pot, weed) is the common name for a crude drug made from the plant Cannabis sativa. The main mind-altering (psychoactive) ingredient in marijuana is THC (delta-9-tetrahydrocannabinol), but more than 400 other chemicals also are in the plant. A marijuana "joint" (cigarette) is made from the dried particles of the plant. The amount of THC in the marijuana determines how strong its effects will be. The type of plant, the weather, the soil, the time of harvest, and other factors determine the strength of marijuana. The strength of today's marijuana is as much as ten times greater than the marijuana used in the early 1970s. This more potent marijuana increases physical and mental effects and the possibility of health problems for the user. Hashish, or hash, is made by taking the resin from the leaves and flowers of the marijuana plant and pressing it into cakes or slabs. Hash is usually stronger than crude marijuana and may contain five to ten times as much THC. Pure THC is almost never available, except for research. Substances sold as THC on the street often turn out to be something else, such as PCP.

New Hampshire -- State Attorney General Kelly Ayotte and county prosecutors have aggressively pushed back against a bill that would legalize marijuana for some seriously ill patients, sending lawmakers a letter calling marijuana an addictive drug and claiming that reclassifying marijuana as medicine could undermine efforts to keep youths from trying drugs. The bill's supporters decry the letter as "misleading" and have circulated a seven-page rebuttal of the two-page letter.

Columbus -- Ohioans favor casino gambling and marijuana used for medical purposes, but they oppose lowering the drinking age, abolishing the death penalty and legalizing gay marriage. That's according to the latest Ohio poll released by the University of Cincinnati May 8.  The university's Institute for Policy Research polled 818 Ohioans in April on a variety of social issues. Times columnist Gregory Sullivan acknowledges marijuana's therapeutic potential, but he argues that federal law must be changed before New Jersey passes its Compassionate Use Medical Marijuana Act (The Times, "Compassionate, but still illegal," Dec. 30). Mr. Sullivan is apparently unaware of the recent U.S. Supreme Court action in the Garden Grove case, which resolved the conflict between federal and state marijuana laws. The U.S. Supreme Court refused to hear, and thus let stand, a decision from California's Fourth District Court of Appeals, which said: "Congress enacted the Controlled Substances Act (CSA) to combat recreational drug abuse and curb drug trafficking. Its goal was not to regulate the practice of medicine, a task that falls within the traditional powers of the states. ... Congress regulates medical practice (only) insofar as it bars doctors from using their prescription-writing powers as a means to engage in illicit drug dealing ... . Beyond this, however, the statute manifests no intent to regulate the practice of medicine generally."

Charles Barkley, the Hall of Fame basketball player and outspoken broadcaster, was arrested in Scottsdale, Ariz., for the suspicion of driving under the influence of alcohol. According to the police report, he was pulled over at 1:27 a.m. Wednesday morning when he ran a stop sign. The Gilbert Police department, which was patrolling the Old Town district of Scottsdale as part of an area DUI Task Force, said that its officers had probable cause to arrest Mr. Barkley after he exhibited signs of impairment and had a strong odor on his breath. He did not take a breath test, but submitted to a blood test, which is required.

A New Year's Eve DUI checkpoint and simultaneous saturation patrol in Selma netted a total of three drivers arrested for suspicion of DUI, according to figures released by the Selma Police Department. From 7 p.m. Dec. 31 until 2:30 a.m. Jan. 1, officers with the Selma PD held the patrols as well as the checkpoint, which was located around Floral Avenue and Willow Street. A total of 414 drivers were screened at the checkpoint, resulting in one arrest for suspicion of DUI. Officers also handed out 12 citations for various vehicle code violations and 10 vehicles were impounded due to unlicensed drivers or those driving with a suspended or revoked driver's license.

Laughlin was charged Monday with DUI after he had a rollover accident last Thursday and the Oklahoma Highway Patrol found an open beer and a mixture of pills. BOSTON — Massachusetts would join 11 other states in decriminalizing the possession of up to an ounce of marijuana, making it akin to a traffic ticket, if voters pass Question 2 on Election Day.
Maryland is one out of the 11 states to include provisions for the use of medical marijuana in their drug laws. In 2003, former Governor Robert Ehrlich signed the medical marijuana affirmative defense law which allows defendants to make a case based on their medical need. Although Maryland is one of the more progressive states to pass such a clause, it still has some of the harshest penalties for recreational use and medical marijuana users can only make their defense after an arrest.

A highly anticipated trial involving conflicting marijuana laws got underway Friday in Los Angeles federal court with a prosecutor painting the owner of a Morro Bay medicinal marijuana store as a brazen drug trafficker who sold dope to teenagers and toted around a backpack stuffed with cash.
During the 1980s criminal penalties for marijuana offenses were made much tougher, at both the state and federal levels. More resources were devoted to their enforcement. And punishments more severe than those administered during the "reefer madness" of the 1930s became routine. As a result there may be more people in prison today for violating marijuana laws than at any other time in the nation's history.

Like many of you, I go to basement shows (or at least I used to before I landed the WW Music Editor gig). And while I’m continually impressed by underage Portland’s capacity for enjoying music of all stripes (be it dancing like crazy or sitting cross-legged on the floor) without being preoccupied by socializing and drinking, I also see the occasional 18 year-old kids getting their teenage kicks by way of some old-fashioned backyard boozin’. Some underage people drink. Obviously.
