Why would some people want to label my son as a gang banger? Why are some people willing to do almost anything to bring my son down? Where is the evidence to support that my son is a gang banger? Michelle Hansee didn’t have evidence to prove that he was a gang banger. A spiderman back pack and a belt? I’m not even a lawyer and I know you need more then this.

So where is the evidence?! A Myspace page? I see a picture of my son on myspace making the peace sign…and some words that you say…he said? Please, give me a damn break. Now my son is a hardcore gang banger? Because of a myspace page? Are you kidding me? This is similar to the picture when Obama was oversees and had on a certain garment. Some people tried to label him as a Muslim. Some people are protecting illegal alien gang bangers and they need my son to be a gang member in order to help their case. But he wasn’t! He was and is, innocent!

Special Order 40 is hobbling police. That's the view of an LAPD officer who writes about the department for National Review Online and other publications under the pseudonym "Jack Dunphy."

Although the order states only that officers can't stop people solely to inquire about their immigration status, "the policy and the reality are quite different," he said in an interview with The Times. The officer asked that his real name not be used.

 
Worried about running afoul of department policy, Dunphy said, some officers are reluctant to take action against illegal immigrants, even known criminals.

As a result, he said, people who have been deported for crimes often return and live in full view of the Los Angeles Police Department.

The latest twist in the unending saga that is the fight over the legacy of Jamiel Shaw is that LA DAs have been putting pressure on his family to shutup about Special Order 40. Or else.

Or else what? Well, they will bring experts to testify that a reasonable person could suspect that Shaw was a gangbanger himself, therefore mitigating the circumstances under which he was gunned down. I'm waiting for a chorus of outrage but given the slight national coverage this matter has had in resonance with black channels of communication, it wouldn't surprise me if they get away with it. Apparently, young Shaw talked like a banger on his myspace site, and wore a red belt on the day of his murder. Well, that's convincing.

A prosecutor has been pulled from the case after clashing with Shaw's parents, who are demanding hate-crime charges against the suspect, believed to belong to a violent Hispanic gang. And the family is fighting suggestions that an affinity for a rival gang was what led to Shaw's slaying March 2.

Let's stand up for a fallen American.  Jamiel Shaw deserved better than what an illegal alien and City Government gave him:  a violent death prior to adulthood.

This poor kid had everything taken from him only a few months before he was to embark off to college.  It's not fair, and more importantly, it isn't right.  We have to raise our voices loudly to make sure his death is not swept under the rug.  If Doug McCyntire and Walter Moore can take some time to bring attention to this situation, so can we.  Let's protest against Special Order 40!

Jamiel Shaw had a loving family, athletic talent, scholarship offers, and most of his life in front of him. And in the blink of an eye, it was all taken by an illegal alien who shot him in the head mere hours after said law violator had been released from prison.

Jamiel starred on the gridiron at L.A. High on Friday nights. With interest in his football prowess being signaled from institutions as prestigious as Stanford University, he had hoped to soon be taking the field on Saturdays, instead. Clearly, that won't be happening. Well, on a Saturday in early May, members of Save Our State will step up and stand in his place. His family's loss cannot be for nothing. Efforts to at least revise aspects of the LAPD's miserable Special Order 40 are underway and as Southern Californians, we have a responsibility to support them.

Let's stand up together. Bring signs (Stay on point. Examples: Support Jamiel's Law ; Special Order 40 Kills; Stop Illegal Immigration ; Make Our City Safe ; Secure Our Borders ; Don't Let Jamiel's Death Be In Vain ; Repeal Special Order 40 , etc.) And bring flags. Let the beautful red, white and blue streaming colors fill the sky. This isn't Mexico, if it was, that poor child's death would be acceptable. This is America, and here we stand up when something is wrong, like the disgusting abdication of duty by local law enforcement and our City Council that brought about the Shaw family tragedy.

Jamiel's Law would apply only to illegal aliens in gangs. However, 

the L.A. Times has confused its readers by publishing a raft of 

articles about the supposed disadvantages of ending "sanctuary 

city" protection for all illegal aliens (e.g., day laborers), 

rather than focusing on those in gangs.

Want to know why? The company that owns the L.A. Times also owns a 

Spanish-language newspaper called "Hoy." Sales at Hoy would plummet 

if L.A.'s "sanctuary city" status ended.

It is the sanctuary policy that gives life to Specical Order # 40.

In the aftermath of the murder of Jamiel Shaw by an illegal alien in Los Angeles, I and others have sent letters to members of the LA City Council asking them to revoke or modify Special Rule 40, which puts restrictions on LAPD officers in determining a person's legal status-even with illegal alien gang members.

Below is a letter I got from City Council member Bernard Parks (formerly Chief of LAPD).

"Thank you for your letter regarding Jamiel's Law. Of course, I feel horrible about what happened to Jamiel Shaw, and I know first-hand the pain that his parents are suffering. However, I don't believe the solution we are all searching for in answer to this devastating incident should be to blindly embrace the politically-motivated misinformation generated by someone who is running for Mayor of the City of Los Angeles.

As stated by a recent edirorial in the Los Angeles Times, which I have enclosed with this letter, these are the facts: Jamiel Shaw's alleged killer was arrested by the Culver City Police Department, incarcerated by the Los Angeles Sheriff's Depoartment, and should have been held by the US Immigration and Customs Enforcement (ICE) office pending review of his immigration status and eventual deportation. As stated in the editorial, 'The tragedy exposes deplorable failures in the jailhouse processing of illegal immigrant criminals, but it has nothing to do with the LAPD, much less Special Order 40'

Further, as proposed, Jamiel's Law is at best poorly written and at worst constitutes racial profiling. While I agree that criminal gang members present a clear and present danger to the communities they inhabit, there is no viable way to determine by cursory inspection during a field stop, the status of the individual stopped"

The city's Special Order 40 prohibits police from making arrests solely for immigration law violations even if officers know a gang member has been previously deported.

Now city councilman Dennis Zine, who spent almost four decades as an active and reserve LAPD officer, wants to allow officers to question gang suspects about their immigration status and require the LAPD to turn over illegal alien gang members to federal immigration authorities.

ZINE: The Shaw killing is one in many. When is it going to stop? And who's going to have the courage to stand up, to say, "If you're here illegally, we understand that." This is not about illegal people who are here, this is about illegal people who are here who are gang banging, who are terrorizing.

ZINE: L.A.'s police chief and mayor both support Special Order 40.

MAYOR ANTONIO VILLARAIGOSA, LOS ANGELES: Every chief of police in the city of Los Angeles since Darrel Gates and virtually every big city members of the police, where there are large immigrant populations, particularly large undocumented populations, believe that the only way that we can fight crime is to make sure that people, that witnesses can come forward, you know, when crimes are committed.

WIANS: Zine rejects that argument, saying otherwise law-abiding illegal immigrants fear gang members, not the police. At least 10 of L.A.'s 15 city council members say they are willing to consider Zine's proposal.

During the Rampart police corruption scandal of the 1990s, officers worked closely with federal authorities to turn over gang members who were suspected of being illegal immigrants, he said. Today's officers are afraid of being accused of similar tactics.

Dunphy said he sees a larger problem with how local and federal authorities deal with illegal immigrants.

He cited the case of Maria Leon, an illegal immigrant whose former Glassell Park home police say was a center of drug activity for years. Leon has been arrested 14 times dating to 1985, according to police and court records. She has three convictions for drug-related crimes and was deported twice.

But Leon was undeterred. Last week, she was arrested by Immigration and Customs Enforcement agents in front of her former Drew Street home. She was charged with illegally reentering the country, a felony that carries a maximum sentence of 20 years in federal prison.

Dunphy said Leon should have been prosecuted for immigration violations sooner.

As for federal authorities, Dunphy said he once called them about a drug dealer he had arrested, an illegal immigrant who had reentered the country twice. But he said the federal agents were not interested because the drug dealer had not been involved in a violent crime.

A sweep covering five states netted almost 300 arrests of illegal aliens on charges of identity theft, document fraud, and being in the country illegally.

The raids were part of a long-term investigation, officials said. Plants were raided in Mount Pleasant, Texas, Batesville, Ark., Live Oak, Fla., Chattanooga, Tenn. and Moorefield, W.Va., authorities said.

Atkinson said the company went to ICE agents with information about identity theft at the Arkansas plant. The company uses a federal database to check identity documents of new employees, but that wouldn't stop a person from using a real, but stolen ID, he said.

Good for the company to initiate action from ICE.  Once they identified who had been using fake Social Security Numbers and other documents, notifying ICE is the responsible course of action.  We usually only hear about the companies who either hide illegal workers or fire them without bringing them to the attention of law enforcement, letting innocent people continue having their identities stolen. 
If "Special Order 40" sounds vaguely like a term from a spy or science fiction thriller, that's in keeping with the surreal conversation that is raging around the 1979 Los Angeles Police Department rule. Specifically, the order has figured centrally in discussions of the murder of 17-year-old Jamiel Shaw, allegedly at the hands of 19-year-old illegal immigrant Pedro Espinoza. As LAPD Chief William Bratton noted recently, much of this conversation has been disconnected from the reality of the order, which governs how officers deal with undocumented immigrants and did not factor into the case at hand.

But the passions around this issue suggest something larger than just confusion about procedure or jurisdiction. The Shaw case opens onto a set of crises around crime, illegal immigration, gangs, proper policing roles and the difficulty of ensuring the rights of citizens and non-citizens in Southern California. For some, Special Order 40 is a symbol of L.A.'s collapse into a lawless "sanctuary city." For others it's crucial to the goal of protecting human rights, while still others see it as an important tool in maintaining civil order. There are plenty of other views as well, and though they don't all have direct bearing on Special Order 40, they speak to the tension and anger felt by many locals.

In a move to stamp out one of the San Fernando Valley's most notorious and violent gangs, the city on Thursday sought one of its most sprawling injunctions against the San Fers to curtail its influence in the Northeast Valley.

District Attorney Steve Cooley and City Attorney Rocky Delgadillo are seeking an injunction that would place severe limits on the gang's estimated 900 members to meet in public, intimidate witnesses and sell or possess drugs, weapons or graffiti tools.

Pedro Espinoza, described by law enforcement as an 18th Street gang member, is scheduled to be arraigned this afternoon in a downtown Los Angeles courthouse. Espinoza was arrested late Friday in connection with Jamiel's slaying death, but authorities did not release information about the arrest until today. He is being held in lieu of $1-million bond.

LAPD officers would be required to report gang members found to be illegal immigrants to federal authorities under a proposal to be introduced in the Los Angeles City Council today. The proposal, by Councilman Dennis Zine, a former LAPD officer, would result in a closer relationship between the department and Immigration and Customs Enforcement officials and is likely to generate controversy.

The plan comes amid a new debate over Special Order 40, a Los Angeles Police Department rule that defines when officers can inquire about the immigration status of suspects. The 29-year-old rule is a cornerstone of the department's policy toward immigrants and is designed to encourage illegal residents who are victims of crimes or witnesses to cooperate with police without fear of deportation.

Zine described his plan as a modification to Special Order 40 that would formalize how police deal with illegal immigrant gang members. Under the proposal, LAPD officers who are investigating gang members who they believe are illegal immigrants would be required to check on their immigration status -- even if the suspects are not under arrest.

If the gang member is found to be in the country illegally, officers would be required to notify immigration authorities. Zine said the hope was that federal officials would take the gang members into custody.

Last year, two groups filed suit arguing that Special Order 40 was in fact illegal under an obscure state code. The lawsuit cites a 2005 Government Accounting Office study involving 55,322 illegal immigrants incarcerated in federal, state and local facilities in 2003. The study found that they had been arrested an average of eight times each with 49% previously being convicted of a felony.

Having local gendarmes not cooperate with the feds puts our safety at risk. We have documented and the public is aware of the growing problem of illegal aliens who are multiple offenders. Yet because no one bothers or is forbidden from checking their immigration status, they are returned to society to commit more crimes or prey on more victims.

Federal immigration authorities have identified 20,000 illegal immigrants in Southern California jails between 2006 and 2008. One can perhaps understand police not informing the feds about the immigration status of someone pulled over for a broken tail light. But someone being released from county jail on a weapons charge?

Jamiel Shaw Sr. asks, "If you're a gang member who is suspected of committing a crime, why can't they check a database at the police station to see if you're here illegally? Why can't they check a data base at the jail?"

As of Monday, writes Joel Rubin of the LA Times about Bratton’s Police Commission report, “….93 people had been killed in Los Angeles this year, compared with 69 during the same period last year.” And the frequency seems to be ramping up. “Two weeks ago, for example, the increase in the homicide rate over last year stood at 27%. The rise is also outpacing those in New York City and Chicago — cities that have seen significant, but less dramatic, increases this year…”

Yet according to some LA residents who attended the meeting (and those I’ve spoken to privately in some of the neighborhoods most affected) race is entering in. There has been, and continues to be, so much vicious racial division and tension inside California’s jails and prisons that to believe it isn’t spilling into the street is unrealistic.

Police Chief William J. Bratton is counting on those raw numbers to deflate what several commissioners and police officials called the "rumors" and "myth" of violent racial tensions between blacks and Latinos. True or not, that sentiment has gained credence in recent weeks with several high-profile slayings and injuries in which suspected Latino gang members killed blacks. In one case, a 6-year-old black boy was shot in the head when two men flashed gang signs and opened fire on the SUV the boy was riding in. Days earlier, 17-year-old football standout Jamiel Shaw Jr. was gunned down on the sidewalk near his home, allegedly by a member of the notorious 18th Street gang. The attacker shot Shaw after demanding to know if the teenager belonged to a gang.

Recently, I wrote on the murder of Jamiel Shaw Jr last month in Los Angeles by an illegal alien gang member who was never deported after being released from LA County Jail. The suspect had served 4 months on a weapons charge. Apparently, when arrested, he told the cops that he was born in LA, and his word was accepted. One day after his release, he shot and killed Jamiel Shaw, a 17-year-old star high school football player and son of a servicewoman serving in Iraq. Had normal procedures been followed, an immigration hold would have been placed on this person, and he would have been deported upon his release. But because Los Angeles is a “sanctuary city”, immigration authorities were never notified. Now, we have a dead youth senselessly murdered.

In response to this outrage, mayoral candidate Walter Moore, with the support of Jamiel Shaw Sr, is asking the LA City Council to revoke the city regulation (Rule 40)that prohibits LAPD officers from even detaining known illegal alien gang members. Yesterday, the two appeared before the City Council to state that “Enough is enough” and plead for their support.

Woo-whee, the testimony was riveting this morning before the Los Angeles City Council when a group of black residents pleaded with the 15 elected council members to rescind Special Order 40, the longtime local rule protecting illegal immigrants from arrest by the LAPD.

The black residents are seeking a decision by the council to enact the so-called Jamiel's Law, named after Jamiel Shaw, a promising and law-abiding 17-year-old high school student allegedly shot by an illegal immigrant, 18th Street Gang member Pedro Espinoza. The noxious Espinoza, who has a massively long rap sheet, was arrested by cops in Culver City, and then released by Los Angeles County Sheriff's Department jailers, shortly before he allegedly murdered Jamiel.

Jamiel's family members cried openly in the ornate Council Chambers, asking the council to allow cops to check on the illegal status of people like Espinoza so they can be deported rather than released.

Council President Eric Garcetti couldn't change the subject fast enough -- to a plan to force even more obnoxious billboards on Angelenos.

The parents of the 17-year-old Shaw spoke in favor of the ordinance Tuesday before the Los Angeles City Council. A 1979 police order bars officers from enforcing federal immigration laws, but the proposed ordinance would require officers to hunt down illegal immigrants who appear to be gang members.

This is a very sad situation here. I have read many of the comments, and I have to say as a black male living in Los Angeles that the latino gang members and black gang members have different perceptions on black and brown violence. Now I dont know what this young man was wearing or how he responded to the person that killed him, but the latino gang members have been committing violence towards any black males as direct hatred for the color of their skin, not because of a gang affiliation.

Here's a law and order issue that deserves a good deal of attention. It's very hot on local radio.

Jamiel Shaw was gunned down by an illegal alien gang member who had just gotten out of jail. Jamiel was not in a gang. If Special Order 40 didn’t stand in the way, the illegal would have been deported, and Jamiel would be alive. It’s as simple as that. We say that Mayor Villar, Chief Bratton and the City Council have blood on their hands! Call City Hall and tell them to support Jamiel’s Law.  Jamiel’s family needs your help.

The killing of the Shaw boy--by all accounts a straight arrow with promise--by an illegal Mexican immigrant gangbanger just out of jail, is very sad. But, hey, L.A. is a "sanctuary city" with a Hispanic mayor and a liberal daily who both promote illegal immigration from Mexico. Undocumented workers, they want us to call them. When they work. Most of them do, here. Taking jobs whites don't want, they like to say. Bull, I say. But the street beggers here are always black or white. Never Hispanic. Gangs? A few. Nothing like East L.A., of course, but where else is like East L.A.?
