当用户发送向设备138请求,如浏览可用的记录、浏览EPG、设置记录优先选项、观看记录,和/或快进记录中的广告部分的请求时,设备138在步骤156确定是否跳过了过多的广告。如果是这样,则设备138在步骤158向用户发送跳过的广告,例如通过在电视机72上播放记录的广告或发送记录的广告到遥控设备140并在其活动显示上呈现。在156,一旦跳过的广告的数量已减少到可接受的水平,则设备138在步骤160准许用户的请求。用户请求可以对应于跳过的广告请求,使得用户可以构建信用,以便将来能够不中断地观看媒体内容。同样,在某些情况下,用户可以不只一次地观看首选类别中的广告,从而根据内置的广告交易方案避免非首选类别中的广告。媒体内容提供商可以减少使用这样的记录设备的用户的订阅费率。方法142在步骤162终止。
在图7中进一步展示了记录设备138。其中,一个或多个调谐器114和解码器118根据用户输入126调谐并解码接收到的广播信号116中的频道。记录功能163根据用户输入126将解码的媒体内容记录在数据存储164中。XML解析器128解析解码的附加数据,根据需要添加元数据,确认组件120基于解析出的附加数据和记录功能163的操作检测广告跳过。这样,将跳过的广告记录在数据存储130中。EPG信息、隐藏字幕、未记录的媒体,和已记录的节目索引通过记录功能163及访问控制模块165作为音频视频输出166发送到活动显示。同样,记录的媒体内容和/或广告通过访问控制模块165作为输出166发送。使用访问控制模块165基于用户跳过和观看广告来维护用户的广告观看信用账户,且只要用户的广告观看信用良好,就将各种媒体作为输出166发送给用户。
参考图8,展示另一个可选实施例。其中,使用记录设备167从广播网络168中接收广播信号,而使用遥控设备169来浏览因特网170。广播网络168和因特网170一起组成了通信网络74。同样,组成本发明的方法的步骤分布在记录设备167和遥控设备169中。相应地,参考图9,本发明的方法开始于步骤171并进入步骤172,其中通过控制接口以控制信号的形式接收用户的观看状态。如果在步骤173检测到频道切换和/或快进,且如果在步骤174广告作为结果被跳过,则将检测到的广告跳过发送到遥控设备。在步骤175,遥控设备执行跳过广告政策。如果根据政策并基于记录在广告管理数据库176中的用户广告观看历史和跳过的广告属性,需要采取动作,则将存储在记录设备上的广告缓冲177中的跳过的广告发送到手持设备,并在步骤178将其直接和/或通过广告发送入口179,如通过电子邮件、语音邮件、文本和/或网页,重发送到遥控设备的活动显示上。在步骤180,通过根据政策调整数据库176中的数据来执行激励政策。
参考图10,记录设备167使用调谐器181来接收和解码广播信号,使用记录功能182将节目存储在节目管理数据库183中,以响应通过控制接口184从遥控设备169接收的控制信号。跳过的广告存储在硬盘驱动器存储185中,而通过通信接口186A将跳过的广告和广告跳过检测发送到遥控设备169。接下来遥控设备169通过通信接口186B接收来自记录设备167的通信。遥控设备169使用广告管理器188来执行跳过广告政策和激励政策,且使用存储用存储器190来维护广告管理数据库。同步器192将接收到的广告和附加媒体重发送到液晶显示(LCD)屏194。用户通过浏览器196访问广告、因特网和/或附加媒体。
根据图11,记录设备167和遥控设备169一起帮助媒体内容中的广告重发送和广告重发送方案。其中,在步骤200以各种形式产生广告和/或媒体内容198。接下来,将这些各种形式的内容从各种不同的来源发送到消费者210,来源包括如电视广播212和入口及/或第三方公司214。因此,记录设备167(图8)和电视机72影响基于电影的媒体(包括广告)的发送,而遥控设备169影响其他、附加和/或对应的形式的媒体(包括广告)的发送。
使用广播信号来进一步帮助媒体(包括广告)的发送,广播信号包括元数据描述所发送的媒体中的各部分。如图12所示,广播信号中的音频视频部分216包括区分不同类型的媒体内容的元数据。元数据218用于描述相邻和/或重叠的媒体内容,包括与其一起嵌入广播信号的广告。因此,例如,相互关联的元数据218层描述在广播信号中特定时间点上的节目和/或相关的广告。例如,广告相关的元数据220描述特定的广告、与其相关的节目、广告的持续时间、可选的标题、类别、跳过惩罚,及称为最高和最低跳过水平的相关的阈值。同样,在特定时间点T1上的节目相关的元数据222A描述特定的节目、与该节目相关的广告、节目持续时间及可选的标题和类别。例如,在后面的时间点T2上的节目相关的元数据222B不同于元数据222A,因为附加的广告与该节目关联。
然而,图13展示了本发明中通过现有的电视广播构建元数据的方法。例如,当以正常的方式在步骤224接收到广播,在步骤226进行记录,并在步骤228附加时间码时,在步骤230基于检测到的空帧并行生成事件标记。接下来在步骤232的事件分析确定所标记的事件的类型,且使用此信息来识别事件标记。此类型的事件标记在标题为“控制录像带播放器自动地扫描过去记录的商业消息的方法和装置”、授予Iggulden等人的美国专利5,333,091中揭示,将其包括在此作为参考。根据本发明,将用于识别事件标记的信息添加到事件标记中,且在步骤234事件标记在回放期间与节目时间码关联,以在步骤236创建元数据,以用于识别记录的广告以便进行重发送,和/或通过因特网检索对应的基于网页的媒体。例如,第二种选择可以由广告内容提供商通过具有在节目中的特定时间关联节目与国家和地方分发的广告信息的数据库来实现。因此,可以基于遥控设备的IP地址、用户正在记录的频道,和构建出的元数据的时间戳,来识别合适的广告。识别广播中的广告部分的事件分析有助于在步骤238中根据基于元数据的方案检测广告跳过。
图14中展示了根据基于元数据的方案检测广告跳过的方法,且在较佳实施例中,此方法由记录设备在回放期间执行。开始于步骤240,该方法包括在步骤242检测回放期间的广告跳过。检测在此上下文中对应于在回放期间对广告自动或用户手动进行的快进或跳过。然后在步骤244从自动地监控和更新的节目管理器数据库183中检索广告的无线广播节目标识。在步骤246检索识别跳过的广告的元数据,并且在步骤248确定是否已观看跳过的广告。例如,如果事先已观看记录的广告,则在步骤250不检测广告跳过,且操作方法在步骤252终止。否则,如果尚未观看该广告,则在步骤254将其保存在广告缓冲177中,且在步骤256将跳过的广告元数据发送到遥控设备,由遥控设备执行广告重发送方法。然后在步骤258从遥控设备接收确定结果,且记录设备做出相应的响应。然后方法在步骤252终止。
在图15中展示遥控设备执行的广告重发送方法。开始于步骤260,在步骤262中,在检测到跳过时接收识别跳过的广告的信息,如元数据。在步骤264,相应地通过添加信息或递增相对于已经存储在数据库176中的对应信息的引用计数,自动更新广告管理器的广告管理数据库176。然后,在步骤266和268中,比较与跳过的广告关联的跳过阈值以及系统索引反映出的用户的广告观看相关的信用账户中的当前余额的点数。当已对现有的音频/视频广播创建元数据时,记录设备可以基于例如跳过的广告的持续时间来分配阈值。
如果用户的广告查看信用足够高,允许用户至少暂时地跳过广告,则遥控器在步骤270提交确定结果来继续节目,并相应地调整用户的信用索引。然而,如果用户的信用账户足够高,可以跳过广告,但是接近于耗尽,则在步骤272向用户提供与广告重发送相关的各种选项,并且将所执行的选项作为确定结果发送到记录设备。例如,用户可以选择在电视机上以其原始形式观看广告、通过因特网检索对应的交互媒体文件、文本消息,和/或网页,和/或让对应的广告通过语音邮件和/或电子邮件发送。此外,如果用户的信用账户耗尽,则在步骤274向记录设备提交确定结果,不允许发生任何更多的广告跳过,直到当前节目结束。在某些情况下,用户可以暂停当前的节目,并通过观看几条广告增加信用账户余额来清除“不跳过”命令。此方法在步骤276终止。
本发明的说明本质上只是示范性的,因此,不偏离本发明宗旨的变化应包括在本发明的范围内。特别地,本发明的广告重发送系统和方法的形式和实现可以取决于特定的时间点上实现本发明的特定业务系统、可用的技术和主流市场力量而不同。例如,通过基于用户的广告观看信用账户控制信号解码,并作为奖励部分或完全地资助用户的订阅和/或视频点播访问,本发明的系统和方法可以在有线电视公司的机顶盒中实现。同样,可以通过完全用因特网实现的视频点播服务来实现本发明,其中用户需要观看广告和/或与广告交互,和/或填写调查表才能接收所需的视频流。此外,本发明可以在具有时移记录能力的电视机中实现。仍然存在其他变化,包括在此所述的实施例的组合和/或其他实现,本领域的普通技术人员可以立即得到这些变化而不费功夫和/或进行大量试验。这样的变化不应视为偏离本发明的精神和范围。

Claims (27)

1.一种广告内容重发送系统,用于实时广播和时移记录,其特征在于,所述系统包括:
检测用户跳过广告内容的确认组件;
接收涉及重发送跳过的广告内容的用户优先选项的输入;及
根据所述用户优先选项向用户重发送跳过的广告内容的重发送模块。
2.如权利要求1所述的系统,其特征在于,所述系统包括通过检测用户与跳过的广告内容的交互,校验跳过的广告内容的重发送的重发送校验模块。
3.如权利要求2所述的系统,其特征在于,所述重发送校验模块包括检测用户在活动显示上对跳过的广告内容的处理的交互检测器。
4.如权利要求1所述的系统,其特征在于,所述系统包括基于用户与跳过的广告内容的交互奖励用户的用户激励子系统。
5.如权利要求4所述的系统,其特征在于,所述用户激励子系统包括基于用户与跳过的广告内容的交互,向用户发送附加媒体内容的媒体接口。
6.如权利要求5所述的系统,其特征在于,所述附加媒体内容对应于提供有关可用的主媒体内容信息的电子节目指南。
7.如权利要求5所述的系统,其特征在于,所述媒体接口用于通过第一活动显示发送附加媒体内容和跳过的广告内容,从而避免侵扰通过第二活动显示进行的主媒体内容发送。
8.如权利要求5所述的系统,其特征在于,所述用户激励子系统包括点数累积子系统,用于允许用户基于用户与跳过的广告内容的交互累积点数,且所述媒体接口对附加媒体内容的发送使用累积的点数。
9.如权利要求1所述的系统,其特征在于,所述系统包括用于存储跳过的广告内容的数据存储。
10.如权利要求9所述的系统,其特征在于,所述确认组件用于在检测到用户跳过广告内容时将广告内容发送到所述数据存储中。
11.如权利要求1所述的系统,其特征在于,所述重发送模块用于根据用户优先选项通过电子邮件向用户重发送跳过的广告内容。
12.如权利要求1所述的系统,其特征在于,所述重发送模块用于根据用户优先选项通过语音邮件向用户重发送跳过的广告内容。
13.如权利要求1所述的系统,其特征在于,所述重发送模块用于通过将跳过的广告内容从记录设备发送到具有活动显示的遥控设备,并通过所述活动显示发送广告内容,来重发送跳过的广告内容。
14.如权利要求1所述的系统,其特征在于,所述系统包括元数据解析器,用于通过添加识别信息到事件标记中来生成元数据,关联事件标记与对应的时间码,并关联元数据与广告内容中的对应部分。
15.一种广告内容重发送方法,用于实时广播和时移记录,其特征在于,所述方法包括:
检测用户跳过广告内容;
存储跳过的广告内容;及
以不干扰用户欣赏主媒体内容的非侵扰方式向用户重发送跳过的广告内容。
16.如权利要求15所述的方法,其特征在于,所述方法包括检测用户与跳过的广告内容的交互,从而校验对跳过的广告内容的重发送。
17.如权利要求16所述的方法,其特征在于,所述检测用户与跳过的广告内容的交互包括检测用户在活动显示上对跳过的广告内容进行的处理。
18.如权利要求15所述的方法,其特征在于,所述方法包括基于用户与跳过的广告内容的交互来奖励用户。
19.如权利要求18所述的方法,其特征在于,所述奖励包括基于用户与跳过的广告内容的交互发送向用户发送附加媒体内容。
20.如权利要求19所述的方法,其特征在于,所述奖励包括准许用户访问提供有关可用的主媒体内容的信息的电子节目指南。
21.如权利要求19所述的方法,其特征在于,所述奖励包括通过第一活动显示发送附加媒体内容和跳过的广告内容,从而避免侵扰通过第二活动显示进行的主媒体内容发送。
22.如权利要求19所述的方法,其特征在于,所述奖励包括:
允许用户基于用户与跳过的广告内容的交互累积点数;及
对附加媒体内容的发送应用累积的点数。
23.如权利要求15所述的方法,其特征在于,所述方法包括:
接收与重发送跳过的广告内容相关的用户优先选项;及
根据所述用户优先选项向用户重发送跳过的广告内容。
24.如权利要求15所述的方法,其特征在于,所述重发送跳过的广告内容包括通过电子邮件向用户重发送跳过广告内容。
25.如权利要求15所述的方法,其特征在于,所述重发送跳过的广告内容包括通过语音邮件向用户重发送跳过广告内容。
26.如权利要求15所述的方法,其特征在于,所述重发送跳过的广告内容包括将跳过的广告内容从记录设备传输到具有活动显示的遥控设备,并通过所述活动显示重发送跳过的广告内容。
27.如权利要求15所述的方法,其特征在于,所述方法包括:
添加识别信息到事件标记中;
关联事件标记与对应的时间码来生成元数据;及
关联元数据与从广播信号中解码得到的广告内容中的对应部分,
其中所述检测用户跳过广告内容包括基于元数据识别在回放对应的主媒体内容期间跳过的广告。
