PERMANENT ATTACHMENT
When doubts arise over what stays with the buyer and what goes with the seller, the general rule is that fixtures that are permanently attached to the wall, floor, or ceiling with nails, screws, glue, or cement generally go with the house to the buyer. To avoid any questions about such matters, sellers should clearly identify those elements of real property that are included with the sale of the house, as well as those elements that the seller intends to take. If a seller has every intention of taking a chandelier or kitchen appliance with him or her, that intention should be clearly stated to the buyer. Otherwise, misunderstandings over refrigerators and chandeliers can unnecessarily lead to broken deals. One of the most common “fixtures” to pose a degree of ambiguity to home buyers are loudspeakers that are mounted to walls. Dishwashers, built-in microwaves, cooktops, and sinks almost always stay with a house. But the refrigerator and the washer/dryer are often up for discussion, as might be a drop-in range. Typically, if it’s built into the cabinetry, it stays. If it’s free-standing, it usually goes with the seller. If you’re thinking of buying a home or listing one, please call us at RE/MAX PREMIER PROPERTIES. We have offices at 800 Milwaukee Ave., Burlington, and 315-B Milwaukee St., Waterford. There is NO SUBSTITUTE for experience and we have plenty of it! We each began our careers in 2004 and have assisted hundreds of clients through the buying/selling process. We can help you too!
